Education Agents

Overview

Johnston Institute works with a network of authorised education agents to support prospective international students who wish to study in Australia.

Education agents assist students by providing information about Johnston Institute programs, the application process, and studying and living in Australia.

Johnston Institute is committed to maintaining the highest standards of ethical recruitment. All education agents representing the Institute must act honestly, ethically, and in the best interests of overseas students, and uphold the reputation of Australia’s international education sector.

Johnston Institute engages education agents in accordance with the Education Services for Overseas Students Act 2000 (ESOS Act) and the National Code of Practice for Providers of Education and Training to Overseas Students 2018.

Approved Education Agents

Only education agents formally appointed by Johnston Institute are authorised to represent the Institute and assist students with applications.

Johnston Institute maintains a list of approved education agents who operate under a formal written agreement with the Institute.

Appointment of Education Agents

Johnston Institute appoints education agents through a formal selection and approval process to ensure they have the knowledge, capability, and integrity required to represent the Institute.

Before appointment, education agents must:

  • enter into a formal written Education Agent Agreement with Johnston Institute
  • demonstrate knowledge of the Australian international education system
  • agree to comply with the Australian International Education and Training Agent Code of Ethics
  • provide accurate and current information about Johnston Institute courses and services
  • comply with the ESOS Act and National Code 2018

The Institute only works with agents who demonstrate ethical business practices and a commitment to supporting genuine students.

Responsibilities of Education Agents

Education agents representing Johnston Institute must:

  • act honestly, ethically, and in good faith
  • provide accurate, current, and complete information about Johnston Institute courses and services
  • assist students to make informed decisions about studying in Australia
  • comply with the Australian International Education and Training Agent Code of Ethics
  • avoid conflicts of interest and disclose any potential conflicts
  • protect the confidentiality of student information
  • ensure marketing and promotional information provided to students is accurate and up to date

Education agents must not:

  • provide migration advice unless registered with the Office of the Migration Agents Registration Authority
  • engage in dishonest or misleading recruitment practices
  • facilitate student transfers that breach National Code requirements
  • create Confirmation of Enrolments (CoEs) for non-genuine students.

Johnston Institute’s Responsibilities

Johnston Institute is responsible for ensuring that its education agents comply with the requirements of the ESOS Act and the National Code 2018.

The Institute will:

  • maintain formal written agreements with each education agent
  • provide agents with accurate and up-to-date marketing and course information
  • ensure agents understand their obligations under the Australian International Education and Training Agent Code of Ethics
  • record and maintain education agent details in the Provider Registration and International Student Management System
  • monitor education agent activities and performance
  • investigate complaints about education agents
  • take corrective action where necessary, including termination of agent agreements.

Monitoring and Quality Assurance

Johnston Institute actively monitors the performance and conduct of its education agents to ensure compliance with regulatory requirements and ethical standards.

Monitoring may include:

  • regular performance reviews
  • analysis of application and visa outcomes
  • feedback from students and staff
  • review of marketing and promotional practices
  • compliance checks against ESOS and National Code requirements.

Where concerns arise, Johnston Institute may implement corrective measures such as additional training, formal warnings, or termination of the education agent agreement.

Ethical Recruitment and Student Protection

Johnston Institute will not accept students from an education agent if the Institute knows or reasonably suspects that the agent is:

  • providing migration advice without being authorised to do so
  • engaging in unethical recruitment practices
  • facilitating student transfers that breach National Code requirements
  • assisting students who are unlikely to comply with student visa conditions
  • creating Confirmation of Enrolments (CoEs) in the Provider Registration and International Student Management System for non-genuine students.

The Institute is committed to ensuring that all recruitment activities support genuine students and maintain the integrity of Australia’s international education sector.

Agent Commission Policy

In accordance with the National Code 2018, Johnston Institute does not pay commissions or provide incentives to education agents for recruiting overseas students who are transferring from another registered provider in Australia in circumstances where such payments are prohibited.

Complaints About Education Agents

Johnston Institute takes concerns about education agent conduct seriously.

If you believe an education agent representing Johnston Institute has behaved unethically, provided incorrect information, or acted inappropriately, you may lodge a complaint with the Institute.

Becoming an Education Agent

Organisations interested in representing Johnston Institute may submit an application to become an authorised education agent.

Applications are assessed based on experience in international education recruitment, knowledge of Australian student visa requirements, and commitment to ethical recruitment practices.

Regulatory Compliance

Johnston Institute records all authorised education agents in the Provider Registration and International Student Management System (PRISMS) in accordance with the Education Services for Overseas Students Regulations 2019, incorporating the 2025 amendments.

The Institute ensures that all education agents operate in accordance with the ESOS Act, the National Code of Practice for Providers of Education and Training to Overseas Students 2018, and the Australian International Education and Training Agent Code of Ethics.
